Eligibility for Court Marriage in Nepal

Under the Civil Code 2017, both parties must fulfill the following eligibility criteria:

Single Status: Both man and woman must not be married at the time of registration. They should have single status or be legally divorced.

Age Requirement: Both individuals must have completed 20 years of age.

Mutual Consent: Both parties must accept each other as husband and wife voluntarily.

Court Marriage Process in Nepal

The court marriage process in Nepal involves the following steps:

Step 1: Fulfill the Eligibility Criteria

Ensure both parties meet the eligibility requirements mentioned above. The application will be rejected if criteria are not fulfilled.

Step 2: Obtain Single Status Certificate

Both individuals must receive a single status certificate (recommendation letter) from their respective ward office based on their citizenship. This letter confirms the person is unmarried or divorced. The application for court marriage should be filed within 30 days of receiving this certificate.

Step 3: Submit Application to District Court

Submit the marriage registration application along with all required documents to the District Court. The application can be filed in any of the 77 districts in Nepal based on residence or convenience. Both individuals must be physically present at the court.

Step 4: Verification of Residence

Either the man or woman must have resided within the District Court jurisdiction for more than 15 days. A temporary residence certificate is required from the ward office if applying in a different district than where citizenship was issued.

Step 5: Submit Deed of Consent

During the marriage registration, both parties sign a deed of consent. Two witnesses from each side must be physically present and sign the deed along with the Marriage Registration Officer.

Step 6: Issuance of Marriage Certificate

After examination by the Judge and verification of all documents, the court issues the marriage certificate. This certificate is legally valid and recognized by government authorities, embassies, and foreign governments.

1. Notarized copy of citizenship of both man and woman

2. Single status certificate from respective ward office (based on citizenship)

3. Notarized copy of citizenship of two witnesses

4. Temporary residence certificate from ward office (if applying in a different district)

5. Four passport-size photos of both individuals

6. Application for marriage registration

7. Divorce decree (if previously married)

1. Single status document (No-Objection Letter) from respective embassy in Nepal

2. If embassy is not located in Nepal: Single status document from government authority of respective country, in English, notarized as per their country's law

3. Temporary residence certificate after completing 15 days stay in Nepal

5. Valid passport with visa
